Terms of Service
SIANE is published by Apps by SAHARA.
These Terms of Service (“Terms”) govern your use of SIANE (“the App,” “we,” “our,” or “us”), a private childhood memory book for iPhone, and this website. By downloading, installing, or using SIANE, you agree to be bound by these Terms.
SIANE is not available yet. These Terms will apply to the App when it launches. If they change before launch, we will update this page and its effective date.
1. Acceptance of Terms
By accessing or using SIANE, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.
2. Eligibility and Accounts
You must be at least 18 years old to create a SIANE account. You are responsible for the activity on your account and for keeping your sign-in details secure. Please tell us right away if you believe someone has accessed your account without permission.
3. License Grant
3.1 Limited license
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use SIANE on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
3.2 Restrictions
You agree not to:
- Copy, modify, or distribute the App or any part of it
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Use the App for any unlawful purpose
- Sublicense, rent, lease, or lend the App to third parties
- Access or attempt to access another family’s memories without their invitation
4. Your Content
4.1 Ownership
You keep all rights to the photos, videos, voice recordings, stories, and other content you add to SIANE (“Your Content”). We do not claim ownership of Your Content.
4.2 Permission to provide the service
To run SIANE, you give us a limited permission to store, process, copy, and display Your Content only as needed to provide the App to you and the people you invite: for example, to sync it across your devices, transcribe your voice, suggest moments, and design and print the books you order. This permission ends when you delete Your Content or your account, except for copies in a book that has already been printed and sent to you.
4.3 Responsibility
You are responsible for Your Content. You confirm that you have the right to add it, and that you are a parent or legal guardian of the child it is about, or have that person’s permission. Please add content about other people thoughtfully and respect their wishes.
5. Family Sharing and Contributors
You can invite other people to see and add to your child’s story. You decide who is invited and what they can see, and you can remove them at any time. Content a contributor adds is theirs, and by adding it they allow it to become part of your family’s story in SIANE. Contributors must also follow these Terms.
6. Writing Assistance
SIANE can transcribe what you say and, when you ask, suggest gentle edits to your words. Suggestions are only suggestions: you choose whether to keep your own words, accept a polished version, or rewrite it. Please review a memory before saving it, as transcriptions and suggestions may not always be accurate.
7. Subscriptions and Purchases
Some features may require a paid subscription or purchase. Subscriptions and in-app purchases are sold and billed by Apple through the App Store, renew according to the terms shown at the time of purchase, and can be managed or canceled in your Apple account settings. Refunds are handled by Apple under its policies.
Printed books, when available, are subject to the price, shipping, and delivery terms shown when you place your order. Because each book is made for your family, we cannot accept returns unless it arrives damaged or with a printing error, in which case please contact us.
8. Exporting and Deleting Your Content
You can export Your Content and delete it, or your account, at any time. We keep your memories for as long as your account is active. See the Privacy Policy for how deletion works.
9. Intellectual Property
SIANE and its original content, features, book designs, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. The App’s name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks.
10. App Store Terms
Your use of SIANE is also subject to the terms and conditions of the Apple App Store from which you obtained the App. In the event of any conflict between these Terms and the App Store terms, the App Store terms shall prevail with respect to your use of the App.
11. Updates and Changes
We may update, modify, or discontinue the App or any features at any time. If we plan to discontinue SIANE, we will give you reasonable notice and a way to export Your Content first.
12. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We work hard to keep your memories safe, and we recommend keeping your own copies of anything irreplaceable.
13. Limitation of Liability
To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the App
- Any unauthorized access to or use of your device or account
- Any interruption or cessation of the App
- Any bugs, viruses, or other harmful code that may be transmitted through the App
- Any errors or omissions in the App
14. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to Your Content, your use of the App, or your violation of these Terms.
15. Termination
You may stop using SIANE and delete your account at any time. We may suspend or terminate your access if you breach these Terms or misuse the App. Unless the breach is serious or the law prevents it, we will tell you first and give you a chance to export Your Content.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
17. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiations. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede any prior agreements.
20. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will update the effective date at the top of these Terms and, once the App is available, let you know in the App. Your continued use of the App after any changes constitutes acceptance of the new Terms.
